Terms and conditions

It’s important that you read our T&C’s as by accessing myturn2talk or use services offered by Kirsten Chalmers of myturn2talk, you are entering into agreement and deemed compliant with these terms and conditions

 

If you do not agree to be bound to any of these terms and conditions, you must not access these services.

Ownership & Laibility

Kirsten Chalmers reversed the rights to this website and its content, which means that you may enjoy the content of the site but if you want to copy  of an images, audio, text or any other form you must request consent from Kirsten Chalmers at kirsten@myturn2talk.com.

 

The information provided on this site is informational purposes only and does not replace medical advice. You hereby release Kirsten Chalmers and myturn2talk from any and all causes of action and claims of any nature resulting from any Services received via Telehealth, phone or through the website, including but without limitation to any act, omission, opinion, response, advice, suggestion, information and/or service of any services provided.

Telehealth Services

You understand that Telehealth services are not intended to replace face to face consultations and you agree to refer to a local General Practitioner when it is practical for you to do so.

 

Telehealth services are not appropriate for all clients therefore Kirsten reserves the right to restrict or terminate your service based on clinical governance requirements and ethical standards.

 

Telehealth services do not constitute a replacement for in-person care from medical professionals, especially in circumstances of medical or mental health emergencies and crises. In the event of such emergencies, please call triple zero (000) immediately. 

Payment for Services

Payment for the services provided to you will be taken from the Direct Debit/Credit Card information provided to our third-party provider Halaxy* at the time of registration. 

 

Payment for the services received by you are required by no later than the day upon which the service is received by you. You confirm and agree to use only Credit Cards or other payment means which you are duly and fully authorized to use, and that all payment related information that you provided and will provide in the future, to or through the website, is accurate, current and correct and will continue to be accurate, current and correct.

Rebate Terms

In order to claim Medicare rebates for Psychological Services, you will need a referral from a GP. Please refer to the Medicare website to determine whether you are eligible for Medicare rebates.

 

If you are eligible for a rebate for services provided by myturn2talk, we will take all reasonable steps to process your rebate claim on your behalf. If however we are unable to process an applicable Government/Medicare Rebate, myturn2talk will bill you the full fee and you will receive an invoice to prove your attendance which you will the need to present to the relevant governing body to receive your rebate.  

 

We make no warranties and provide no guarantees as to the accuracy, timing or success of such rebate applications processed on your behalf and by agreeing to these Terms of Service you are hereby indemnifying myturn2talk and its employees, agents and authorised officers against all loss, damage, injury, claims and objections.

Cancellations Fees

The reasons for our Cancellation and Late Attendance policy are to ensure that our services are provided equally and fairly to all our clients who need them.

 

We understand that emergencies and extenuating circumstances can occur and will endeavour to respond to your situation as quickly and as possible, however by accessing our services you accept the following conditions:

 

  • Cancellations must be received in writing (this includes a text)

  • Cancellations given 48 hours or more prior to the event, no cancellation fee applies.

  • Cancellations given 24 – 48 hours prior to the session will attract a 50% fee.

  • Cancellations given less than 24 hours prior to the event, or a ‘’no show” will attract the full fee.

 

Please Note: Cancellation fees are not eligible for Medicare rebate, which means you will be out of pocket for this fee.

 

Subsequent sessions will not be booked until all outstanding fees are paid.

Lateness Terms

  • If you are late to a Telehealth appointment, Kirsten Chalmers will wait for ten (10) minutes before considering the appointment to have been forfeited by the client and the policy for Cancellations Given less than 24 Hours prior to the event, as above, will apply. 

  • If you arrive for their appointment within the initial ten (10) minutes from the start of the appointment, the entire duration of the appointment will be shortened by the amount of time the client was late.

  • You hereby agrees to indemnify and keep indemnified myturn2talk against all claims, loss, damage, injury, objections or litigation arising from cancellations made under these Terms & Conditions. 

Privacy & Confidentiality

Myturn2talk is bound by the privacy policies, rules and guidelines of their relevant professional association as well as applicable Australian laws and legislation. As part of the provision of Services to you, it will be necessary for us to collect, record and maintain personal information from you which is relevant to your personal contact details, medical history and any other information relevant to the services we provide you. The terms of our Privacy and Consent Policy are drafted to ensure our compliance with Australian privacy law. 

 

This information is stored on Halaxy*, a secure private practice software (please refer to the Halaxy Collection statement below.

Use of Personal Information

The personal information you or your legal guardian or parent provide to Kirsten Chalmers and myturn2talk is used to administer and manage the services provided to you by our Service Providers. 

 

Notwithstanding the best endeavours taken by Kirsten Chalmers and myturn2talk, no warranty is given as to the suitability of the Service Provider provided for your needs. During your treatment and from time to time, Kirsten Chalmers and myturn2talk may be required to share your confidential information with, or otherwise request confidential information from, third parties such as Registered Medical Professionals (including Psychologists, Counsellors, General Practitioners or Psychiatrists), who are also bound by confidentiality obligations. 

 

By agreeing to these Terms of Service, you authorise us to make such disclosures to third parties as required by law or as otherwise required to third parties involved in your treatment. We will endeavour to take all reasonable steps to ensure that your confidential information is handled with due care and provided in accordance with our confidentiality requirements and the confidentiality requirements of third parties. 

Halaxy Collection 
Statement

Halaxy Pty Ltd ACN 633 220 612 ('we', 'us' or 'our') collect personal information about you in order to provide you with services relating to health records of you or your patients and for purposes otherwise set out in our Privacy Policy.

 

The information you provide will be collected by or on behalf of us and may be disclosed to third parties, including those that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all our services to you. Your data is stored in Australia, and we may disclose your personal information to recipients that are located outside of Australia, for example, to Xero (which stores data in the USA) if Halaxy practitioner accounts are integrated to Xero.

 

Our Privacy Policy explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. Our Privacy Policy sets outs out how we collect, use, store and disclose your personal information. We are bound by the Australian Privacy Principles contained in the Privacy Act.

 

This policy applies to practitioners and consumers alike, and practitioners’ patients are required to get their patients’ consent to their data being stored in Halaxy and covered by this Privacy Policy and the Terms.

 

By providing personal information to myturn2talk, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

 

Personal Information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, gender, postcode and contact details. It may also include financial information, including your credit/debit card and/or bank account information.
